Protecting your privacy is important to us

ACTXPLORER PRIVACY POLICY

Actxplorere (“Actxplorer, “we”, “us” or “our”), in Singapore, maintains the website at https://www.actxplorer.com (the “Site”) and provides related services (collectively, such services, including any new features and applications, and the Site, the “Services”). We have developed this privacy statement (as updated and amended from time to time, this ‘Privacy Statement’) to explain how we collect, use, communicate and disclose certain information.

1.    Information Collected and How it is Used

Personal Information

Actxplorer collects Personal Information from you when you voluntarily provide such information through use of the Services (e.g. when you register for access to the services, use certain Services, contact us with inquiries or purchase an experience through us). Actxplorer does not sell or disclose your Personal Information for any purpose without your explicit consent or authorisation (see PDPA Notice at Appendix A)

Non-Personally Identifiable or Aggregated Data

When you interact with Actxplorer through the Services, Actxplorer automatically receives and records certain Non-Personally Identifiable Information, including your IP address, browser type, access times and the pages you request. Actxplorer may use such information to track for example, the total number of visitors to the Site, the number of users who visit each page of the Site, the domain names of our users’ Internet service providers and how our users use and interact with the Services. Also, we may make anonymous, compile and aggregate Personal Information into Non-Personally Identifiable Information.

We may use information we collect from or about you to:

  • allow the Host to contact you or otherwise fulfill the Experience you purchased through the Site;
  • administer your account and provide you with Services and customer support;
  • tailor the features, content, performance and support of the Site and Services to you;
  • provide you with personalised ads and offers for products and services from us and our affiliates or business partners;
  • perform analyses and conduct customer research;
  • respond to your requests, resolve disputes and/or troubleshoot problems;
  • verify your compliance with your user obligations in our Terms of Service; and
  • improve the quality of the Site and Services.

Cookies

A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a website’s computers and stored on your computer’s hard drive. When you visit the Site, we send one or more cookies to your computer or other device. We use cookies to improve the quality of the Services, including the storage of user preferences and tracking user trends. We may also use third party tracking services to track and analyse Non-Personally Identifiable Information associated with users of our Site and Services. Such third parties may use Cookies to help track user behaviour. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. Some of the Services and the Site’s features require you to accept cookies. If you configure your browser to reject cookies, you will not be able to take advantage of these Services and features.

We do not share Personal Information with Third-Party Ad-Servers; however, Third-Party Ad-Servers may automatically collect Non-Personally Identifiable Information about your visit to the Site and other websites, your device address, your Internet Service Provider and the browser you use to visit the Site. They do this by using Cookies, clear gifs and other technologies. Information collected may be used, among other things, to deliver advertising targeted to your interests and to better understand the usage and visits to the Site and the other websites tracked by these third parties. Third Party Ad Servers may collect and use Personal Information from other sources as part of its ad serving. This Privacy Statement does not cover the collection methods or use of the information collected by Third-Party Ad-Servers, and Actxplorer is not responsible for Cookies, clear gifs, or other technologies in third party ads. We encourage you to review the privacy policies or statements of these Third-Party Ad Servers to learn more about their use of Cookies and other technologies.

We do not collect Personal Information about your online activities over time and across third-party Web sites or online services. As a result, we do not alter any of our data collection and use practices upon receipt of a web browser’s “do not track” signal, as they do not apply to the Services or our Site. Where a user or web browser transmits a “do not track” signal, third parties that place cookies and collect information on the Site will be able to see that such a signal has been transmitted.

Host Profiles

If you host an Experience that is featured on the Site the Profile you create, including any Personal Information, will be publicly displayed on the Site. Actxplorer users and Customers may use information about our Hosts featured on our Site and may publicly comment about the Experiences they offer. Actxplorer does not control our Customers’ or users’ use of Host profile data or any other publicly available information.

2.    Disclosure of Your Personal Information to Third Parties

In certain circumstances, some of your Personal Information may be made available or shared via the following means:

Purchase of an Experience. If you purchase an Experience, as part of that transaction, your full name (as provided to us) will be made available to the Host, Facilitators, and other Actxplorer users. You agree that although we contractually limit how Hosts use Actxplorer’s customers’ Personal Information, we cannot control or be liable for any use of your Personal Information by Hosts, Facilitators or other Customers using the same Experience.

Business Transfers. Actxplorer may choose to engage in certain business transactions, such as buying or selling assets. In the event of such a transaction, we may disclose your Personal Information to parties or prospective parties to those transactions.

Vendors. Actxplorer may hire other companies to perform business-related functions on behalf of Actxplorer (“Vendors”). Examples of such functions include processing email or other communications, maintaining databases and processing payments. When using Vendors, we provide them only with the information necessary to perform their specific function and are required to treat any Personal Information they process in a manner that is consistent with the terms of our Privacy Policy.

 

Legal Requirements. Actxplorer may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect or defend the rights or property of Actxplorer, (iii) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or the public, violations of Actxplorer’s Terms of Service, or (iv) protect against legal liability.

With Your Consent. Actxplorer may disclose your Personal Information to Third Parties with your consent. For example, where you elect to participate in competitions or other activities organised in conjunction with a Third Party, Personal and Non-Personal Information that you provide in that context may be shared and disclosed in the context of your participation.

Actxplorer may also share Non-Personally Identifiable Information and user statistics in its discretion in order to describe the Services to current and prospective business parties and to other third parties for other lawful purposes.

3.    Options Available to the User

Actxplorer may use your Personal Information to contact you to promote Services we believe may be of interest to you. In such cases, each communication sent by us to you will contain instructions on how to “opt-out” of receiving future promotional communications.

In some instances, we may send you service-related communications that are transactional in nature, e.g. an email confirming your purchase of an Experience or a cancellation of such Experience. There is no opt-out option for transactional communications of this nature.

If your Personal Information changes, you may correct or update it by logging into your account, emailing us at contact@actxplore.com or by messaging support via the Site. Please note that any Personal Information that has been disclosed to third parties in accordance with our Privacy Policy cannot be corrected, modified or deleted.

You may deactivate your account by emailing contact@actxplore.com or by messaging support via the Site. Actxplorer will take all reasonable steps to respond to your request within 10-20 business days. Actxplorer will retain your Personal Information for as long as your account remains active or as needed to provide you with Services, maintain a record of your transactions for financial reporting purposes, and where necessary to comply with our legal obligations, prevent fraud, resolve disputes, troubleshoot problems and enforce any agreements.

4.    Security

Actxplorer endeavours to take all reasonable steps, including implementing administrative, technical and physical controls, to protect your Personal Information. Your acceptance of our Privacy Policy constitutes an acknowledgment that no communications over the Internet, or method of electronic storage is 100% secure. You acknowledge and accept that Actxplorer cannot guarantee absolute security of your Personal Information and that this should be taken into consideration when deciding what Personal Information you choose to provide.

5.    Privacy Policies of Third Parties

This Privacy Statement only addresses the use and disclosure of information by Actxplorer through your interaction with the Site. Other services and websites that are accessible through links from the Site may have their own privacy statements and policies in relation to the collection, use and disclosure of Personal Information. We encourage you to familiarise yourself with the privacy practices and policies of third parties prior to disclosing any of your Personal Information.

6.    Children’s Privacy

Pursuant to Actxplorer’s Terms of Service, you must be at least 18 years old to utilise our services. In accordance with the Children’s Online Privacy Protection Act, we do not collect or maintain Personal Information directly from individuals that are known to us to be under 13 years of age. Parents or other authorised adults may submit to us information about children under 13 years of age that are or will be participating in an Actxplorer Experience, and such information will be protected in accordance with the practices relating to all other Personal Information. If it comes to our attention that a child under the age of 13 has directly submitted his or her Personal Information to the Site, we will take all steps necessary and possible to remove such Personal Information from our databases.

7.    Changes to our Privacy Policy

Actxplorer will update this Privacy Policy from time to time to clarify our practices and to reflect new or different privacy practices (e.g. when we add new services, functions or features to the Site). Any updates to the Privacy Policy will be reflected by the date last revised (found at the top of the Policy). Notice will be provided to you should any material changes need to be made to this Privacy Policy.

9.    Glossary of Terms

Business Partners means, collectively, third parties with whom we conduct business, such as Experience Providers, merchants, co-marketers, distributors, and resellers. Our Business Partners’ use of Personal Information obtained through Actxplorer is governed by their privacy policies and not subject to our policies or oversight.

Cookie means a small amount of information that a web server sends to your browser that stores information about your account, your preferences, and your use of the Site and other Web sites. Some cookies are temporary, whereas others may be configured to last longer. “Session cookies” are temporary cookies used for various reasons, such as to manage page views. Your browser usually erases session cookies once you exit your browser. “Persistent cookies” are more permanent cookies that are stored on your computers or mobile devices even beyond when you exit your browser.

Non-Personally Identifiable Information means information that alone cannot identify you, including data from Cookies and other technologies. Non-Personally Identifiable Information may be derived from Personal Information.

Personal Information means information about you that specifically identifies you or, when combined with other information we have, can be used to identify you. This may include information such as your name, email address, home address, phone number, and in some cases, persistent identifiers.

Third-Party Ad-Servers means Vendors and other third parties that provide the technology to place ads on websites and track ad performance.

Vendors means, collectively, third parties that perform business operations on behalf of Actxplorer, such as transaction processing, billing, mailing, communications services (e-mail, direct mail, etc.), marketing, data processing and analytics, servicing, collections, or ad management.

10.  ENFORCEMENT OF POLICY

If for some reason you believe ACTXPLORER has not adhered to these principles, please notify us and we will do our best to promptly make corrections.

APPENDIX A

DATA PROTECTION NOTICE (PDPA)

This Data Protection Notice (“Notice”) sets out the basis which Actxplorer Pte ltd (“we”, “us”, or “our”) may collect, use, disclose or otherwise process personal data of our customers in accordance with the Personal Data Protection Act (“PDPA”). This Notice applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes.

PERSONAL DATA

  1. As used in this Notice: “customer” means an individual who (a) has contacted us through any means to find out more about any goods or services we provide, or (b) may, or has, entered into a contract with us for the supply of any goods or services by us; and “personal data” means data, whether true or not, about a customer who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.
  2. Depending on the nature of your interaction with us, some examples of personal data which we may collect from you include your name and identification information such as your NRIC number, Passport number, contact information such as your address, email address or telephone number, nationality, gender, date of birth, marital status, photographs and other audio-visual information, employment information and financial information such as credit card numbers, debit card numbers or bank account information.
  3. Other terms used in this Notice shall have the meanings given to them in the PDPA (where the context so permits).

COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

  1. We generally do not collect your personal data unless (a) it is provided to us voluntarily by you directly or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”) after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws. We shall seek your consent before collecting any additional personal data and before using your personal data for a purpose which has not been notified to you (except where permitted or authorised by law).
  2. We may collect and use your personal data for any or all of the following purposes:

(a) performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;

(b) verifying your identity;

(c) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;

(d) managing your relationship with us;

(e) processing payment or credit transactions;

(f) sending your marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, lucky draws, membership and rewards schemes and other promotions;

(g) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

(h) any other purposes for which you have provided the information;

(i) transmitting to any unaffiliated third parties including our third party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes; and

(j) any other incidental business purposes related to or in connection with the above.

  1. We may disclose your personal data:

(a) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods or services requested by you; or

(b) to third party service providers, agents and other organisations we have engaged to perform any of the functions listed in clause 5 above for us.

  1. The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

WITHDRAWING YOUR CONSENT

  1. The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request in writing or via email to our Administrator of Data Protection at the contact details provided below.
  2. Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within ten (10) business days of receiving it.
  3. Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described in clause 8 above.
  4. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.

ACCESS TO AND CORRECTION OF PERSONAL DATA

  1. If you wish to make (a) an access request for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your personal data, or (b) a correction request to correct or update any of your personal data which we hold about you, you may submit your request in writing or via email to our Administrator of Data Protection at the contact details provided below.
  2. Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request.
  3. We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).

PROTECTION OF PERSONAL DATA

  1. To safeguard your personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures such as antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of personal data by us, and disclosing personal data both internally and to our authorised third party service providers and agents only on a need-to-know basis.
  2. You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

ACCURACY OF PERSONAL DATA

  1. We generally rely on personal data provided by you (or your authorised representative). In order to ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing our Administrator of Data Protection in writing or via email at the contact details provided below.

RETENTION OF PERSONAL DATA

  1. We may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.
  2. We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.

TRANSFERS OF PERSONAL DATA OUTSIDE OF SINGAPORE

  1. We generally do transfer your personal data to countries outside of Singapore to our third party service providers, agents and other organisations we have engaged to perform any of the functions listed in clause 5 above for us.

  1. This Notice applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your personal data by us.
  2. We may revise this Notice from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued use of our services constitutes your acknowledgement and acceptance of such changes.

When I interact with Actxplorer through the Services, I hereby acknowledge that I voluntarily give my consent to Actxplorer Pte Ltd to collect, use and disclose my personal data to the assigned organizations and agencies whether local or overseas for the purposes of processing my registration, administering my participation throughout the period, as well as for travel and accommodation purposes, notifying and contacting me regarding the related events and activities via calls, text messages, post and emails.
